The day\u00a0trip featured on this website is offered for sale by MARY D ENTERPRISES hereinafter\u00a0referred to as the \u201cCompany\u201d. In the Conditions (as defined below) the following expressions\u00a0shall have the meanings defined hereunder:<\/p>\n<ul>\n<li>\u201cBooking\u201d means the steps taken by the passenger to enter into a Contract with the Company.<\/li>\n<li>\u201cBooking Terms &amp; Conditions\u201d means the terms and conditions and the information\u00a0contained in the relevant Company brochure and\/or other information which will form the\u00a0express terms of your contract with the Company.<\/li>\n<li>\u201cCompany\u201d means. MARY D ENTERPRISES whose registered address is 1 bis rue Dame\u00a0Lechanteur, Baie de l\u2019Orphelinat, 98800 Noumea, New Caledonia, who organizes day trips to\u00a0Amedee Island.<\/li>\n<li>\u201cContract\u201d means the contract concluded between the Company and the Passenger relating to\u00a0the day trip which is evidenced by the issue of the confirmation invoice sent by the Company\u00a0or its Sales Agent to the passenger.<\/li>\n<li>\u201cDay trip\u201d means the day trip or package as described in the relevant Company brochure or\u00a0other documentation produced for or on behalf of the Company.<\/li>\n<li>\u201cDisabled Person\u201d or \u201cPerson with Reduced Mobility\u201d: means any person whose mobility\u00a0when using transport is reduced as a result of any physical disability (sensory or\u00a0musculoskeletal, permanent or temporary), intellectual or psychosocial disability or\u00a0impairment, or any other cause of disability or impairment or as a result of age, and whose\u00a0situation needs appropriate attention and adaptation to his\/her particular needs for the services\u00a0made available to all passengers.<\/li>\n<li>\u201cForce Majeure\u201d means any unforeseeable and unpredictable event out of the Company\u2019s\u00a0control including Acts of God (such as, floods, earthquakes, storms, hurricanes or other\u00a0natural disasters), war, invasion, act of foreign enemies, hostilities (regardless of whether war\u00a0is declared), civil war, rebellion, revolution, insurrection, military or usurped power or\u00a0confiscation, terrorist activities, riots, civil disturbances, industrial disputes, natural and\u00a0nuclear disasters, fire, epidemics, health risks, nationalization, government sanction,\u00a0blockage, embargo, labor disputes, strikes, lockout or interruption or failure of electricity or\u00a0telephone service and\/or any unforeseen technical problems with transport including changes\u00a0due to rescheduling or cancellation or alteration of flights, closed or congested airports or\u00a0ports .<\/li>\n<li>\u201cPackage\u201d means the return trip to Amedee Island, the proposed activities, the meals, the\u00a0table drinks and the show. It does not include the extra activities or products offered on the\u00a0island.<\/li>\n<li>\u201cPassenger\u201d means each and every person named either on the Booking confirmation or on\u00a0the invoice or on a ticket issued by the Company<\/li>\n<li>\u201cSales Agent\u201d means the person who sells or offers for sale the day trip or Package put\u00a0together by the Company, or on behalf of the Company.<\/li>\n<\/ul>\n<p><a href=\"#english1\">1. BOOKING PROCEDURE<\/a><br \/>\n<a href=\"#english2\">2. CONTRACT<\/a><br \/>\n<a href=\"#english3\">3. PRICES AND PRICE GUARANTEE<\/a><br \/>\n<a href=\"#english4\">4. SMOKING POLICY<\/a><br \/>\n<a href=\"#english17\">17. LAW AND JURISDICTION<\/a><br \/>\n<a href=\"#english18\">18. ERRORS, OMISSIONS AND CHANGES<\/a><br \/>\n<a href=\"#english19\">19. USE OF WEBSITE.<\/a><a name=\"english1\"><\/a><\/p>\n<h3>1. BOOKING PROCEDURE<\/h3>\n<p>1.1 In order to proceed with a Booking, the Passenger must contact the Company by\u00a0telephone, email, via his\/her hotel or go in person to the Company\u2019s sales agency. He\/she can\u00a0also make a booking on the Company\u2019s internet site.<\/p>\n<p>1.2 By booking for the day trip or Package, the person making the booking confirms, agrees\u00a0and accepts that all persons named in the Booking request and on the invoice have agreed to\u00a0be bound by the Booking Conditions and that he\/she has authority to accept these Booking\u00a0Conditions on behalf of all the persons named on the Booking request and invoice.<\/p>\n<p>1.3 A Booking will be completed and the Contract will be effective only when the Company\u00a0accepts the booking by sending a ticket confirmation to the Passenger or to the Passenger\u2019s\u00a0Sales Agent. Any Client, who books online will receive a confirmation by email and will pick\u00a0up his\/her tickets at the time of boarding on the day of the excursion.<a name=\"english2\"><\/a><\/p>\n<h3>2. CONTRACT<\/h3>\n<p>2.1 Every day trip is subject to availability at the time of booking. No day trip shall be\u00a0possible until the full amount is paid and the confirmation ticket provided to the Passenger.\u00a0For all online bookings the tickets will be picked up at the time of boarding on the day of the\u00a0excursion.<\/p>\n<p>2.2 Full payment is required no later than 48 hours prior to departure.<\/p>\n<p>2.3 If the booking application is made less than 48 hours prior to departure, then full payment\u00a0must be made.<a name=\"english3\"><\/a><\/p>\n<h3>3. PRICES AND PRICE GUARANTEE<\/h3>\n<p>The Company reserves the right to change the price of the excursions it offers at any time.\u00a0The Company offers the day trip at different rates, such as student, senior, family tariffs.\u00a0These tariffs are not available online, but the Company\u2019s sales team will provide information\u00a0on these offers to all Clients.<a name=\"english4\"><\/a><\/p>\n<h3>4. ONLINE PURCHASES<\/h3>\n<p>For all online purchases, whatever the date of the day trip, the Client must pay for his\/her\u00a0tickets via the secure online payment system \u2018Paybox\u2019. If for any reason the Company cannot\u00a0confirm the availability of a certain daytrip, it will refund the purchase of the day trip tickets.<a name=\"english5\"><\/a><\/p>\n<h3>5. PROMOTIONS<\/h3>\n<p>At certain times of the year the Company can make special offers, the price of which is not\u00a0shown in the Brochure. Such special offers and their respective conditions cannot be\u00a0determined in advance. For all information regarding promotions Passengers should consult\u00a0their travel\/sales agency or the official Amedee Island website: www.amedeeisland.com.\u00a0For all promotional prices, the ticket cannot be refunded, changed or transferred.<a name=\"english6\"><\/a><\/p>\n<h3>6. PASSENGER IDENTITY<\/h3>\n<p>Passengers wishing to benefit from the residents\u2019 tariff must provide official identification\u00a0when they purchase their tickets and when they board.<a name=\"english7\"><\/a><\/p>\n<h3>7. FITNESS TO TRAVEL<\/h3>\n<p>7.1 The safety of all Passengers is of paramount importance to the Company, hence all\u00a0Passengers warrant that they are fit to travel by sea and that their conduct or condition will not\u00a0impair the safety or convenience of the vessel and the other passengers, and that they can be\u00a0carried safely in accordance with applicable safety requirements established by national law.<\/p>\n<p>7.2 The Company has the right to require the Passenger to produce medical certificates\u00a0supporting the fitness to travel and reserves the right to refuse boarding rights to any\u00a0passenger who according to the Company is not fit to travel or whose medical condition could\u00a0constitute a danger for him\/herself or other passengers.<\/p>\n<p>7.3 The Company expressly reserves the right to refuse boarding rights to any Passenger who\u00a0appears to be in any advanced state of pregnancy and shall have no liability in respect of such\u00a0refusal.<a name=\"english8\"><\/a><\/p>\n<h3>8. DISABLED PERSONS AND PERSONS WITH\u00a0REDUCED MOBILITY<\/h3>\n<p>8.1 The Company provides an all-terrain wheel chair free of charge for disabled persons. This\u00a0wheelchair allows disabled passengers and persons with reduced mobility to move around the\u00a0whole of the island.<\/p>\n<p>8.2 The Passenger is asked to provide full details at the time of booking if the Passenger is\u00a0Disabled or has Reduced Mobility so that the necessary assistance can be organized.<\/p>\n<p>8.3 If after careful assessing the Passenger\u2019s specific needs and requirements, the Company\u00a0concludes that the Passenger cannot be carried safely and in accordance with applicable safety\u00a0requirements then the Company can refuse to accept a booking or embarkation of a Disabled\u00a0Person or Person with Reduced Mobility on the grounds of safety.<\/p>\n<p>8.4 The Company reserves the right to refuse to carry any Passenger who in the opinion of the\u00a0Company and\/ or the Carrier is unfit for travel or whose condition may constitute a danger to\u00a0themselves or others on the day trip on the grounds of safety.<a name=\"english9\"><\/a><\/p>\n<h3>9. FOOD ALLERGIES<\/h3>\n<p>Passengers are reminded that some foods may cause an allergic reaction in certain people due\u00a0to intolerance of some ingredients. In order to inform passengers of the ingredients relevant\u00a0signs are placed in front of each dish and specify if the dish contains gluten, peanuts, meat etc\u00a0or not.<a name=\"english10\"><\/a><\/p>\n<h3>10. CANCELLATION BY THE PASSENGER<\/h3>\n<p>If the Client wishes to cancel or postpone the day trip, he\/she should inform the Sales Agency.\u00a0It will be necessary for the Client to return the tickets that he\/she received at the time of\u00a0booking. The Company will then reimburse the Client or postpone the day trip to another date\u00a0chosen by the Client.<\/p>\n<p>The Company does not charge a cancellation or modification fee except for special offers\u00a0which are not refundable. This will always be specified to the Client at the time of booking.\u00a0The Company cannot refund, change or transfer any ticket purchased online.<a name=\"english11\"><\/a><\/p>\n<h3>11. BOOKING CHANGES EFFECTED BY THE\u00a0COMPANY<\/h3>\n<p>The Company reserves the right to cancel or postpone the daytrip.<\/p>\n<p>11.1 If for whatever reason, except for grounds regarding the Client, the Company cancels the\u00a0day trip, the Company will offer to reimburse the Client according to its refund policy or to\u00a0postpone the day trip.<\/p>\n<p>11.2 If the Company cancels the day trip the Client will be reimbursed by the Sales or Travel\u00a0Agency at the price actually paid by the client.<a name=\"english12\"><\/a><\/p>\n<h3>12. THE COMPANY\u2019S LIABILITY<\/h3>\n<p>12.1 The Company is not responsible for any improper or non-performance which is:<br \/>\na) wholly attributable to the fault of the Passenger.<br \/>\nb) the unforeseeable or unavoidable act or omission of a third party unconnected with the\u00a0supply of any service to be provided under the Contract;<br \/>\nc) an unusual or unforeseeable circumstance beyond the control of the Company and\/or\u00a0anyone who supplies services which form part of the Package the consequences of which\u00a0could not have been avoided even if all due care had been exercised, including (but not\u00a0limited to) an event of force majeure; or<br \/>\nd) an event which the Company and\/or anyone who supplies services which form part of the\u00a0day trip could not even with all due care have foreseen or forestalled.<\/p>\n<p>12.2 The liability of the Company is excluded for claims arising out of loss or damage directly\u00a0or indirectly occasioned by circumstances where performance and\/or prompt performance of\u00a0the Contract is prevented by reason of war, or threat of war, riot, civil strife, industrial dispute\u00a0whether by the Company\u2019s employees or others, terrorist activity or the threat of terrorist\u00a0activity, failure of power supplies, health risks or epidemics natural or nuclear disaster, fire or\u00a0adverse weather conditions or adverse sea states, Passenger\u2019s suicide or attempted suicide or\u00a0the Passenger\u2019s deliberate exposure to unnecessary danger (except in an attempt to save\u00a0human life), or the consequences of participating in an unusual and dangerous activity and\u00a0any other circumstance of any nature whatsoever outside the Company\u2019s control.\u00a0The company is not responsible for any theft of personal belongings during the day trip.<a name=\"english13\"><\/a><\/p>\n<h3>13. PASSENGER RESPONSIBILITY<\/h3>\n<p>13.1 The Company will be under no liability whatsoever to any Passenger in respect of any\u00a0breach or non-observance by any Passenger of the provisions of this clause and any Passenger\u00a0shall indemnify the Company against any loss or damage occasioned to the Company or any\u00a0of its suppliers by such breach or non-observance.<\/p>\n<p>13.2 Passengers\u2019 behavior must not affect and reduce the safety, peace and enjoyment of the\u00a0day trip by other Passengers.<\/p>\n<p>13.3 Passengers must not bring live animals, firearms, ammunition, explosives or flammable,\u00a0toxic or dangerous substances, or any similar goods or articles onboard any vessel.<\/p>\n<p>13.4 Passengers shall be liable for any damage suffered by the Company and\/or the Carrier\u00a0and\/or any Supplier of any service that forms part of the Package as a result of the Passenger\u2019s\u00a0failure to comply with his contractual obligations. In particular, the Passenger shall be liable\u00a0for all damages caused to the vessel or its furnishings and equipment, for injury or loss to\u00a0other Passengers and third parties, and also for all penalties, fines and expenses attributable by\u00a0the Passenger that the Company, Carrier or Supplier may be liable to pay.<a name=\"english14\"><\/a><\/p>\n<h3>14. COMPLAINTS<\/h3>\n<p>Any Passenger with a complaint whilst on the day trip must bring it to the attention of the\u00a0Company within 1 month after the day trip.<a name=\"english15\"><\/a><\/p>\n<h3>15. DATA PROTECTION<\/h3>\n<p>In accordance with the Data Protection Act of 6 January 1978, certain passenger data are\u00a0collected which are necessary for booking. The data are collected by the Sales Agent at the\u00a0time of booking, transferred to the Company and used for the organization of the day trip.\u00a0Passengers\u2019 personal data can be collected on paper or by electronic means. The Client has\u00a0the right to access, refuse or rectify all the data that concern him\/her and can do so by\u00a0contacting his \/her Travel Agency or the Company, specifying his\/her first and last names and\u00a0his\/her address.<a name=\"english16\"><\/a><\/p>\n<h3>16. SMOKING POLICY<\/h3>\n<p>16.1 The Company respects the needs and desires of all clients, and has carefully considered\u00a0the subject of those who smoke and those who do not.<br \/>\n16.2 A designated smoking area is reserved for smokers and those who wish to use it.<br \/>\n16.3 Smoking is permitted on each ship, (indicated by signage).<br \/>\n16.4 Throwing cigarette butts over the side of the ship is prohibited.<a name=\"english17\"><\/a><\/p>\n<h3>17. LAW AND JURISDICTION<\/h3>\n<p>These Terms and Conditions are subject to French law. Any action, suit or proceedings\u00a0against the company and\/or the interpretation of this Contract will be brought in the Paris\u00a0Commercial Court.<a name=\"english18\"><\/a><\/p>\n<h3>18. ERRORS, OMISSIONS AND CHANGES<\/h3>\n<p>Every effort has been made to ensure accuracy of the brochure content but certain changes\u00a0and revisions may take place after the printing of the brochure. The Sales team will inform\u00a0Clients of any changes.<a name=\"english19\"><\/a><\/p>\n<h3>19. WEBSITE USE<\/h3>\n<p>The website is available on the basis of an \u2018as-is\u2019 service and is accessible according to\u00a0availability. The Company is in no way liable if for maintenance operations or technical\u00a0problems beyond its control, the User cannot access the website, or if the access is interrupted\u00a0at any moment or if any technical failure prevents the Client from completing any operation.\u00a0The Company does not guarantee that the website is free of computer viruses or other\u00a0technical problems beyond its control.\u00a0Every effort has been made to ensure accuracy of the website content but certain changes and\u00a0revisions may take place in the description of the services and\/or the prices between the\u00a0publication and the release of the information.
